(1) The overseas Chinese or foreign national may apply for incorporation of a new enterprise in Taiwan under the name of a natural person or a foreign company. The flow chart for incorporating a new enterprise by foreign nationals can be viewed in this Commission''''''''s website.
(2) According to the Statute for Investment by Foreign Nationals, if a foreign national invests in an enterprise whose shares are not traded on the stock exchange, OTC counter or emerging stock counter, he/she shall complete and submit to this Commission an application form, together with the relevant attachments thereto (Note- Form A is available at the Commission’s website, including the descriptions of the application form and required documents), regardless of the investment amount.
(3) According to Article 6 of the Statute for Investment By Foreign Nationals, the types of capital contribution include (a) cash; (b) machinery and equipment or raw materials for own use; (c) patent, trademark, copyright, know-how or other intellectual proprietary rights; (d) any other property investable upon approval of the competent authority.
(4) The relevant incentive policies on foreign investments in Taiwan can be viewed thru the website of the (Department of Investment Promotion, Ministry of Economic Affairs).
(5) The foreign individual investor or the corporate representative designated by the foreign investor may assume as Chairman or Vice Chairman of the invested company
(6) The employment of Taiwanese employees by the foreign investor for the invested enterprise shall conform to the relevant labor laws and regulations promulgated by the Council of Labor Affairs. Please check with the Council or its website on this regard.
